Affiliate Program Terms and Conditions

No coupon sites: Your affiliate link and discount code are meant to be shared directly with your audience through your social media platforms, blog, or privately with friends and family. Posting on third-party coupon or discount websites will result in immediate deactivation of your account.
No use on Weddell Water ads: Please do not post your code on Weddell Water’s own ads, boosted posts, or comment sections. Affiliate codes should only be promoted on your own content.
Active participation required: Affiliates who do not have any code usage or do not share about Weddell Water products (via Instagram, TikTok, blog, YouTube, etc.) for six consecutive months may have their account and code automatically deactivated.
Discount Code Details:
- Affiliate discount codes do not provide free shipping.
- Codes are valid only on weddellwater.com and do not apply to our Amazon store.

Weddell Water – Affiliate Program Terms & Conditions

This Affiliate Agreement (the “Agreement”) is entered into as of the date of acceptance (the “Effective Date”) between Weddell Water, LLC (“Weddell Water”), with its principal place of business in Irvine, California, and the individual or entity submitting the affiliate application (“Affiliate” or “you”). Each of Weddell Water and Affiliate may be referred to herein individually as a “Party” and collectively as the “Parties.”

By enrolling in the Weddell Water Affiliate Program (the “Program”) through Refersion, you agree to the following terms and conditions:

1. Services

As an Affiliate, you agree to:

Promote Weddell Water products (including the Weddell Duo shower filter and replacement cartridges) through your unique affiliate link and/or coupon code provided by Refersion.
Generate original content (social media posts, blogs, websites, newsletters, etc.) that truthfully and accurately represents Weddell Water’s products.
Clearly disclose your affiliate relationship with Weddell Water in accordance with FTC guidelines.
Act as an independent contractor, not an employee, agent, or partner of Weddell Water.

You determine when, where, and how to promote our products, provided such activities remain compliant with this Agreement.

2. Restrictions

Affiliates may not:

Make false, misleading, or derogatory statements about Weddell Water or its products.
Resell Weddell Water products, including gifted or discounted units, for commercial gain.
Promote via paid search ads or bid on Weddell Water branded keywords (including variations and misspellings).
Place promotions on sites or channels that contain offensive, obscene, or unlawful content.
Engage in fraudulent activity, such as self-purchasing through your own affiliate link or coupon code, generating artificial traffic, or using unauthorized incentives.

3. Commissions & Payouts

Commission Rate: Affiliates earn 10% commission on the Net Revenue of all Qualifying Orders tracked through Refersion.
Net Revenue: Defined as the retail selling price actually paid by the customer, less taxes, duties, shipping, discounts, and processing fees.
Qualifying Orders: Purchases made by customers using the Affiliate’s unique link or coupon code within the tracking attribution window.
Attribution Window: A 90-day cookie period from the customer’s initial click through the Affiliate’s unique link. Orders placed within this period will be attributed to the Affiliate.
Exclusions: Orders that are refunded, canceled, fraudulent, or made by the Affiliate themselves are not eligible for commission. Subscription sales generate commission only on the first order.
Payments: Commissions are calculated monthly and issued through Refersion Unified Payments. Payments are generally made on the second Tuesday after the first Monday of each month, but may occasionally be issued on the third Tuesday. Affiliates must maintain accurate payment details in Refersion to receive payouts.
Taxes: Affiliates are solely responsible for any applicable taxes on commissions. U.S. affiliates earning $600 or more annually must submit a W-9 form before further payments are released.

4. Intellectual Property

Affiliates are granted a limited, non-exclusive, non-transferable license to use Weddell Water’s trademarks, logos, and approved creative assets solely for participation in the Program.
All rights in Weddell Water’s intellectual property remain with Weddell Water. Affiliates may not register domain names, social handles, or advertising keywords that include Weddell Water’s marks.
Content created by Affiliates may be reposted, repurposed, or otherwise used by Weddell Water across its marketing channels with credit, without further compensation beyond earned commission.

5. Confidentiality
Affiliates may gain access to confidential business information (e.g., pricing, marketing plans, testing data). Such information must not be disclosed to third parties or used for purposes outside this Agreement.

6. Compliance & Representations

Affiliates represent and warrant that they will:

Comply with all applicable laws, regulations, and advertising standards, including the FTC Guides Concerning Endorsements and Testimonials.
Make only factual statements about Weddell Water products based on personal experience.
Not infringe the rights of any third party in the creation of promotional content.
Be at least 18 years old (or the age of majority in their jurisdiction).

7. Term & Termination

This Agreement is effective upon acceptance and continues until terminated by either Party.
Either Party may terminate at any time, with or without cause, upon written notice (including email).
Weddell Water may immediately terminate this Agreement if the Affiliate breaches any material provision.
Upon termination, outstanding commissions will be paid only on Qualifying Orders made prior to the effective date of termination and within the applicable 90-day attribution window. Orders placed after termination will not qualify for commission, even if they fall within the cookie period.
All rights and licenses granted under this Agreement will immediately cease upon termination.

8. Limitation of Liability
To the maximum extent permitted by law, Weddell Water shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program. Liability shall not exceed the total commissions paid to the Affiliate in the six months preceding the claim.

9. Governing Law
This Agreement shall be governed by and construed under the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in Orange County, California.

10. Miscellaneous

This Agreement constitutes the entire agreement between the Parties regarding the Program and supersedes all prior agreements or communications.
Weddell Water reserves the right to update or modify these terms at any time. Affiliates will be notified of material changes via Refersion or email.
Failure to enforce any provision does not constitute a waiver.
Affiliates may not assign their participation in the Program without prior written consent from Weddell Water. Weddell Water may assign its rights or obligations without consent.
